TERMS & CONDITIONS

Timberbush Tours Limited ("the Company") accepts your ("the Customer") booking under the following terms and conditions. Timberbush Tours is the trading name of Timberbush Tours Limited, Registered in Scotland 279983; Registered Office 19 Rutland Square, Edinburgh. EH11 2BB. Where the terms "the company", "Timberbush Tours", and "Timberbush Tours Ltd", are used they are to be regarded as meaning "Timberbush Tours Limited".


Payment
Reservations will only be confirmed on receipt of full payment.

Pricing and Discounts

Whilst reduced entry to some visitor attractions may be available, and any such will be made clear by the guide, tour prices are for transport and driver-guide services only.  All cruises, visits to castles, etc, are optional extras and along with meals and other refreshments are at travellers' own expense. 

Reduced discount prices are offered to persons over the age of 60, full-time students and children between 5 and 16 years. The Company regret that children under 5 cannot be carried.
"Low Season" refers to the period 1 November 2005 to 24 March 2006 inclusive, except 21 December 2005 to 4 January 2006 inclusive.

Cancellations and Refunds
The Company reserves the right to cancel any tour where the minimum number of passengers required is not reached. In such cases the limit of the Company's liability to the Customer is the return of any monies paid.
Where the Customer cancels the tour reservation then the effective date of cancellation will be the date the Company receives written notification. In the event of cancellation a charge,as detailed below, shall be payable by the Customer.

Charges
For all tours of more than 1 day

a) Cancellation more than 14 days before the tour date 10%
b) Cancellation less than 14 days before the start of the tour entirely at the Company's discretion.
For 1 Day & 1/2 Day Tours
a) Cancellation more than 72 hours before tour departure 10%
b) Cancellation less than 72 hours before the tour departure entirely at the Company's discretion.


Alternatives/Cancellations
While the Company shall do everything reasonably possible to provide your tour itinerary and details as planned, the Company reserves the right to alter itineraries, transport or accommodation for whatever reason. In the case of hotel accommodation a similar standard of alternative accommodation will be obtained wherever possible.


The Company reserves the right to refuse to carry any person whose conduct or manner is likely to cause offence or upset to other passengers. In such cases full cancellation charges apply and the Company shall have no further liability to that passenger.


Other operators/carriers
The Company will not accept or have any liability for any acts or omissions whether negligent or otherwise of any supplier or person providing services in connection with any tour unless such a person is employed by or under the direct control of the Company. Tickets for travel on other carriers are subject to the normal conditions of carriage of the individual carrier.


Luggage
Unless otherwise notified passengers are restricted to one medium sized suitcase/bag and one carry-on bag per person. Luggage is carried free of charge but at the passenger's own risk.


Insurance
The Company strongly recommends that passengers arrange suitable travel, medical and cancellation insurance.


Smoking
Smoking is not permitted on coaches but there are frequent stops en route for passengers who wish to smoke.


Force Majeure
The Company does not accept any liability for any loss, inconvenience or damage caused by war, threat of war, riot or civil commotion, terrorist or criminal activity, industrial disputes, natural disasters, fires, sickness, weather conditions, road or traffic conditions, temporary technical, mechanical or electrical breakdown within booked accommodation, explosion of, or radioactive contamination from, any nuclear facility or other events beyond the control of the Company.


Jurisdiction
These conditions shall be construed and interpreted in accordance within the Law of Scotland and the Parties each submit to the jurisdiction of the Scottish Courts.

Please note that when giving information for the purposes of making your Booking, you will be deemed to consent to Timberbush Tours Limited holding and using that information to send you details of other products and services the Company provide or intend to provide that it thinks may be of interest to you.  If you would prefer your information not to be used in that way, please contact the Company, giving you name and address: (i) in writing, (ii) by e-mail, or (iii) by telephone.
